Probate is a county function, so where you file matters. Bexar County borders several others, and some cities cross the county line into Comal, Guadalupe, Medina, Wilson, or Atascosa. Here is how to know which probate court has your case.
Cross-county suburb map
Several San Antonio-area cities sit on or across a county line, so the mailing city does not tell you the court. Venue follows the decedent's county of residence (Texas Estates Code § 33.001).
Schertz
Schertz spans three counties, Bexar, Guadalupe, and Comal, so the mailing city alone never sets the court. File in the county the decedent actually lived in, not the postal city.
Fair Oaks Ranch
Fair Oaks Ranch extends across Bexar, Comal, and Kendall counties. Confirm the exact address before you decide where to file, because a home on the Comal or Kendall side is not a Bexar County probate.
Selma
Selma straddles the Bexar, Guadalupe, and Comal county lines, so the mailing address alone does not settle the court. Venue follows the decedent's county of residence.
Garden Ridge
Garden Ridge sits mostly in Comal County with a portion in Bexar. A home on the Comal side is a Comal County probate even with a San Antonio-area address.
Cibolo
Cibolo is mostly in Guadalupe County with a small part reaching Bexar. The county of residence, not the Cibolo address, decides which court hears the case.
You must file all probate documents at the county clerk's office in the county where the deceased person lived. For local estates, the Bexar County Clerk accepts these probate filings and assigns your case to a court to begin the estate administration process.
If the deceased lived in Bexar County, you must file the initial probate application at the county courthouse. The Bexar County Clerk accepts probate filings and processes the paperwork to officially open the estate.
The city of Selma sits across county lines, with sections in Bexar County and sections in a neighboring county, so the correct place for probate depends on which portion of the city the deceased person actually lived in. If the decedent lived in the Bexar County section of Selma, you will file the probate application with the Bexar County Clerk.
